Terms of Service
Effective Version: December 2, 2025
Welcome to Docauecom, operated by Docau Ecom LLC. Your access and use of the services, products, and content on our online platform signifies that you have read, understood, and unconditionally accepted all of the terms and conditions detailed below. These terms constitute not only a binding legal contract between you (the User/Customer) and Docau Ecom LLC but also the fundamental basis governing every aspect of our e-commerce relationship, including payment rules and financial responsibilities. Please note that if you disagree with any term, no matter how minor, you are expressly prohibited from using or continuing to use our Services. These terms are fully and non-exclusively applicable to all users, including those who access the website without making a purchase transaction.
PART I: GENERAL AGREEMENT AND LEGAL BASIS
1. Full Acceptance of Terms and Electronic Contract
By accessing or using the Website, you affirm that you have reached the necessary legal age to enter into a binding contract (at least 18 years old or the age of majority in your jurisdiction) and possess the full legal capacity to accept these Terms of Service. Your acceptance is considered a legally valid electronic signature, establishing a binding electronic contract. If you are accepting these terms on behalf of an organization, you warrant that you have the authority to bind that organization to these Terms. Your continued use of the Service after any changes to these Terms shall also be deemed your renewed acceptance of the modified terms.
2. Definition of Parties and Scope of Service
"Service" or "platform" includes the entire Docauecom website, related mobile applications, interactive features, content, products (Apparel POD and Home & Living) sold, and customer support services provided by Docau Ecom LLC. "User" or "Customer" is any individual or entity who accesses, browses, shops, or uses any part of the Service. Docau Ecom LLC reserves the right, in its sole discretion, to limit, refuse, or create different conditions for providing the Service to any individual, geographical area, or jurisdiction without prior notice.
3. Basic Financial Rules (Billing Foundation)
These terms constitute the basis for all financial transactions between you and Docau Ecom LLC. All payments for products, applicable taxes, and related fees must be made through a valid and authorized payment method. You agree to provide current, complete, and accurate account information for all purchases made on the Platform. You are responsible for the accuracy of the payment information provided and are liable for all charges incurred under your account. Docauecom reserves the right to refuse or cancel any order in case of suspected fraud or inaccurate payment information.
4. Changes, Adjustments, and Updates to Terms
Docau Ecom LLC reserves the absolute and sole right to modify, replace, or update any part of these Terms of Service at any time without prior notice other than posting the changes on the Website. It is your responsibility to periodically review the Terms of Service for changes. Your continued use of or access to the Website following the posting of any changes constitutes your irrevocable acceptance of those changes. If you object to any changes, your sole remedy is to discontinue using the Website and the Service.
5. Priority of Terms of Service over Other Policies
In the event of any conflict or inconsistency between these Terms of Service and any other policies, guidelines, or specific terms published on the Website (e.g., Privacy Policy), the terms set forth in this Terms of Service document shall take precedence and control, unless Docau Ecom LLC explicitly declares in writing that a specific separate policy shall have priority.
PART II: USE OF SERVICE AND USER ACCOUNT
6. General Conditions for Use and Access
The Service is provided for your personal, non-commercial use. You agree not to copy, duplicate, resell, or exploit any portion of the Service, use of the Service, or access to the Service without express written permission from us. You agree not to use the Service for any illegal or unauthorized purpose and will not violate any laws in your jurisdiction (including but not limited to copyright laws). A breach or violation of any of the Terms will result in the immediate termination of your Services.
7. Responsibility for Data and Accuracy of Account Information
You are responsible for providing current, complete, and accurate account and purchase information in all transactions. Maintaining the security of your account and password is your sole responsibility. You must immediately notify us of any unauthorized use of your account or any other breach of security. Docau Ecom LLC will not be liable for any loss or damage arising from your failure to comply with this security obligation. We reserve the right to suspend or terminate your account if the information provided is false, inaccurate, incomplete, or fraudulent.
8. Account Security and Risk of Unauthorized Access
All activities that occur under your account, regardless of whether you are aware of them, are your responsibility. We recommend using strong passwords and not sharing your login information with any third party. Should you suspect your account has been compromised, you must immediately change your password and contact the Docau Ecom LLC support team. Docau Ecom LLC is not liable for any damages resulting from the unauthorized use of your account, but you may be held liable for losses incurred by Docau Ecom LLC or others due to such unauthorized use.
9. Prohibited Conduct
You are strictly prohibited from using the website or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet.
10. Right to Monitor and Account Suspension
Docau Ecom LLC reserves the right (but has no obligation) to monitor, edit, or remove any content posted by Users that we determine in our sole discretion is unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Service. We reserve the right to suspend or terminate your access to the Service at any time, without notice, for any reason, including, but not limited to, a breach of these Terms of Service.
PART III: INTELLECTUAL PROPERTY AND CONTENT
11. Docau Ecom LLC's Intellectual Property Rights
All content, features, and functionality of the Website and the Service, including but not limited to all information, software, text, displays, images, video, audio, graphic designs, product layouts, and the arrangement thereof (collectively, "Intellectual Property"), are the exclusive property of Docau Ecom LLC, its licensors, or its content suppliers, and are protected by United States and international copyright, trademark, patent, and other intellectual property laws. Your use of the Service does not grant you any ownership rights in our Intellectual Property.
12. Product Design Copyright (Apparel POD and Home & Living)
Apparel and Home & Living products sold on Docauecom may utilize designs under the Print-on-Demand (POD) model. You acknowledge that the graphic designs, images, and slogans used on the products, except for those explicitly provided by you (see section 13), are the intellectual property of Docau Ecom LLC or our licensed designers/partners. You may not copy, reproduce, or use these designs for commercial purposes beyond purchasing and utilizing the finished product from the Platform.
13. User-Generated Content (UGC)
If the Service allows you to post, upload, publish, submit, or transmit content (including designs, comments, reviews), you must ensure that you either own or have all the necessary licenses, rights, consents, and releases to use that content. By posting UGC, you grant Docau Ecom LLC a perpetual, non-exclusive, transferable, royalty-free license to use, reproduce, modify, distribute, publicly display, and otherwise exploit that UGC throughout the world, on any media, for the purpose of operating and promoting the Service. You are solely responsible for the legality of the UGC.
14. Copyright Infringement Notice (DMCA Compliance)
Docau Ecom LLC respects the intellectual property rights of others and adheres to the Digital Millennium Copyright Act (DMCA). If you believe that any material on the Service infringes upon any copyright which you own or control, you may send a Notice of Infringement to our designated Copyright Agent with all the elements required by the DMCA. Any notice that does not comply with the requirements of the DMCA will not be considered sufficient notice.
PART IV: PURCHASE TERMS AND PRODUCT AVAILABILITY
15. Product Availability, Description, and Pricing
We strive to display as accurately as possible the colors, features, specifications, and details of the products (Apparel POD, Home & Living) available on the Service. However, we do not guarantee that the colors, features, specifications, and details of the products will be accurate, complete, reliable, current, or free of errors. Especially for POD products, there may be minor variations in color and print placement between the screen display and the actual physical product. Product prices are subject to change without notice.
16. Order Limits and Right to Refuse Transaction
Docau Ecom LLC reserves the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made.
17. Payment and Additional Transaction Fees
You agree to pay all charges and fees associated with your purchase (including sales taxes, use fees, and other government charges, if any) at the prices in effect at the time the charges are incurred. You agree that Docau Ecom LLC may charge such amounts to your payment method without further authorization. Payment must be made in United States Dollars (USD). Any international currency conversion costs incurred due to your transaction shall be your sole responsibility.
18. Risk of Loss and Title
All items purchased from Docauecom are made pursuant to a shipment contract. Under the commercial standard of F.O.B. Shipping Point, the risk of loss and title for such items pass to you upon our delivery to the carrier. Docauecom assumes no legal liability for any loss, damage, or delay that occurs after that point.
Special Exception (Customer Service Commitment): Notwithstanding the legal transfer of risk, Docauecom maintains a separate Return & Refund Policy, which commits to fully refunding the order value to the customer if the order is confirmed by the carrier to be completely lost in transit. This refund commitment is a voluntary service policy by Docauecom and does not alter the legal transfer of risk under the shipment contract as stated.
PART V: DISCLAIMERS AND LEGAL LIMITATIONS
19. Disclaimer of Warranties
You understand and agree that your use of the Service is entirely at your sole risk. The Service and all products provided through the Service are provided on an "as is" and "as available" basis, without any warranties, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Docau Ecom LLC does not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that the results that may be obtained from the use of the Service will be accurate or reliable.
20. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Docau Ecom LLC, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, loss of savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service. Docau Ecom LLC's maximum liability for any claims related to a purchase transaction shall not exceed the amount you paid for that specific product.
21. Indemnification
You agree to indemnify, defend and hold harmless Docau Ecom LLC and our parent, subsidiaries, affiliates, partners, directors, officers, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
22. Governing Law and Dispute Resolution Jurisdiction
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law principles. Any disputes arising out of or related to these Terms of Service shall be brought in the federal and state courts located in Colorado, and you consent to the personal jurisdiction of those courts.
23. Other Provisions: Entirety and Severability
These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and govern your use of the Service. If any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service; such determination shall not affect the validity and enforceability of any other remaining provisions.

25. Errors, Inaccuracies, and Omissions
Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).
26. Termination and Post-Termination Obligations
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination.
